Member trustees announced


GEMS Rule 19.1 states that the business of the Scheme shall be managed by a Board of Trustees consisting of 12 persons who are fit and proper to be trustees. In addition the Rules provide for fifty percent of the trustees being elected by Members from their ranks and the remaining fifty percent being appointed by the Minister for the Public Service and Administration.  For succession planning purposes, 50% of the employer appointed trustees and 50% of the Member elected trustees shall have a tenure of 4 years while the remainder of the trustees shall have a tenure of three years.

In respect of trustees appointed by the Minister for the Public Service and Administration, Rule 19.8.1 stipulates that the Minister shall nominate which 3 of the 6 Employer trustees will have a tenure of 4 years.  GEMS Rule 19.8.2 stipulates further that, in respect of the first Member elected trustees, the three candidates who obtain the highest number of votes pursuant to their election shall serve as trustees for a period of 4 years and the remaining 3 Member elected trustees shall serve as trustees for a period of 3 years.

In compliance with the Rules of GEMS, the Minister has appointed six trustees to the Board and the first members' trustee election process was concluded on 18 June 2007.

The Scheme is proud to announce that the names of the trustees who will serve on the Board of Trustees with effect from 13 July 2007 are as follows:

In accordance with Section 54 of the Medical Schemes Act No 131 of 1998 the board of trustees shall -

  • take all reasonable steps to ensure that the interests of beneficiaries in terms of the rules of the medical scheme and the provisions of this Act are protected at all times;
  • act with due care, diligence, skill and good faith;
  • take all reasonable steps to avoid conflicts of interest; and
• act with impartiality in respect of all beneficiaries.
