GEMS supports the Protection of Personal Information (POPI) Act

 We are committed to protecting your personal data

On 26 November 2013, the President signed into law the Protection of Personal Information Act (Act 4 of 2013 – “POPIA”). Following the appointment of the Regulator in December 2016 and the publishing of the final POPIA regulations in December 2018, POPIA came into effect on 1 July 2020. POPIA gives effect to the constitutional right to privacy, regulates the manner in which personal information may be processed and provides rights and remedies to protect personal information.

GEMS is classified as a Responsible Party in terms of POPIA and is committed to complying with POPIA as well as other applicable data protection and privacy legislation.

Your right to privacy and security is very important to us.

In order for us to continue to provide you with high quality healthcare and service you are required to disclose your Personal and Health Information to us.  We will always treat your personal information as private and confidential. 

GEMS and its contracted Service Provider Network (SPN) collect personal information for the purposes set out in the Scheme’s Registered Rules, POPIA Policy and otherwise communicated to you. We use your information for a number of different purposes, for example to provide authorisation for medical procedures and pay claims, and to meet our legal and regulatory obligations.

Examples of members’ and dependants’ personal information that is processed by us includes, but are not limited to:

  • Names, surnames, and ID numbers;

  • Employment details;

  • Contact details (telephone numbers, email and other addresses);

  • Banking details;

  • Health information (clinical diagnosis, blood test results, details of medication, etc.)

GEMS collects data via the following:

  • Medical service providers (Doctors, dentists, hospitals, etc)

  • Employers;

  • Members’ application form;

  • Disease management registration processes;

GEMS and its contracted Service Provider Network (SPN) will continue to provide all members with equitable access to affordable and comprehensive healthcare and promote member wellbeing in a secure protected environment.
